Employers and employees should be clear on their rights and obligations and have them set out in a written agreement. This reduces the time needed to resolve a dispute should one arise. It also reduces the chances of incurring a penalty (for example paying a fine for breaching a statute).

A key issue for employers is following the correct processes where an employee's conduct could give rise to a claim against the employer. Defects in the process, or making damaging admissions, will encourage claims, increase the cost of settling them and can be fatal to your case if a dispute ends up in court. In many cases, a claim can be completely avoided by following the correct process and being careful about communications (both internal and external).

While it sounds self-serving, avoiding lawyers or bringing them in late in a matter will often represent false economy as the cost of remedying the situation will almost inevitably be greater than if the lawyers had been used to draft or check agreements, provide advice on rights and obligations and advise on processes and communications up front.
